>> reporter: yeah. the baby last seen, taken from this apartment on helen eve in sunnyvale. the baby's father took him out and was going to run some errands and some after sent a text to the baby's mother saying they were leaving for good and if anybody called the cops the baby would be hurt. this is two-week-old henry guler-romero the subject of a statewide amber alert. police say his father mesut guler left the apartment he shared with the baby's mother around 4:30 yesterday afternoon. >> and shortly thereafter, sent her text messages saying he had taken the child. >> reporter: and that he was planning to move the child out of state. >> he indicated to her that if the police were involved, he would cause harm to himself and the child. >> reporter: the mother called police at 10:30 last night. the amber alert was issued and broadcast statewide. since then the suspect's phone has been tracked to san diego. >> the wife told us he has friends in mexico, which led you see to believe he would be head he had in that direction. >> reporter: guler is turkish,

22 years old, about 6 feet, 120 pounds. police say he had a recurring argument with the baby's mother about wanting to move back to new york. police think he is driving a 2004 gmc envoy similar to this one, california license 6hil892, with a large american eagle decal on the rear window. >> we immediately notified the border patrol of the license plate, vehicle description and his description. we don't believe he crossed the border at this time. >> reporter: so of police have been unwilling -- so far police have been unwilling to discuss any criminal history he may have had. anne makovec, kpix 5. in less than an hour, san francisco authorities are expected to release details on their investigation into the patient found dead in a hospital stairwell. questions are also being raised about a potential witness being sought in the case. that witness reportedly told a

hospital worker that he saw 57- year-old lynne spalding lying in the stairwell days before she was found. an attorney in the case wonders if that man even exists. san jose state university slashing $4 million out of its spring semester budget meaning dozens of classes are being cut in almost every department. students will have a very difficult time now getting classes and if they do get into the classrooms, they will be packed. school officials telling kpix 5 the university has been trying to cut spending for two years. >> this is not easy. this is not anything -- this is not something anyone wants to do, but we need to spend within the confines of our budget that we are going to meet. so we'll look at all our options. >> they have cut enough already. it's just more stuff they are trying to cut making the window of opportunity a little smaller. >> san jose state was initially supposed to cut almost $16 million in classes and programs this year but that number came down significantly after voters passed prop 30 to end school budget cuts. a plan to build expensive

condos on san francisco's waterfront won't be happening now that the voters have rejected it. 62% voted no on prop b and stopped the plan for the 8 washington development. voters also rejected a related measure, prop c, which would have allowed taller buildings at the location. environmentalists and affordable housing advocates strongly opposed that plan. in sunnyvale, voters approved stricter gun control laws. measure c requires gun owners now to report a loss or theft of a weapon to police within two days. firearms will have to be locked up when not in the owner's direct possession. and ammo magazines that hold more than 10 rounds will be banned in the city. the nra will sue to stop it. president obama heads to dallas today to promote the affordable care act. lawmakers on capitol hill are pressing his administration over the website's shortcomings. as mall of america reports, health and human services secretary kathleen sebelius -- as danielle nottingham reports, health and human services

find themselves at the mercy of identity thieves. >> reporter: the obama administration promises to release enrollment figures next week but a house committee issued a subpoena to get the subpoena by this friday. danielle nottingham, cbs news, capitol hill. >> the head of the senate finance committee democrat max baucus told sebelius back in april he saw the affordable care act as a huge train wreck. a fund is collecting money to help a man pay medical bills after being set on fire on an ac transit bus. 18-year-old high school senior sasha fleischman was sleeping on the bus monday evening and woke up to found his clothes in flames. police used surveillance images from the bus and talked to a number of witnesses to finally arrest the 16-year-old suspect. he was escorted to jail right from class at oakland high. fleischman is listed in stable condition. eight people are homeless in san francisco after a fire gutted through this outer richmond building. the two-alarm fire started before 4:00 this morning. flames quickly spread to the

roof. that building has homes, retailtions and a church. everyone -- retail shops and a church. everyone got out safely. parks in san francisco will soon be off limits overnight. the board of supervisors voted yesterday to shut them down between midnight and 5 a.m. supporters say it will reduce vandalism and illegal dumping. but homeless advocates say it will displace thousands of people who sleep at parks. it could take at least a month for the new law to take effect. a locker room fight at cal sent a freshman runningback to the hospital. it happened on friday between players who don't travel with the team. 18-year-old fabiano hale received stitches and was treated for a concussion. the university says it's cooperating with the investigation by campus police. and for the first time, the miami dolphin accused of bullying a rookie teammate says the scandal will blow over. >> what do you have to say about the storm you're in? >> you know what? i'm just trying to wet storm right now. and, uhm, this will pass. >> incognito appears calm and

he easily won re-election over democratic challenger barbara bruono. christ any managed to get more than 60% of the vote this is democratic leaning state. it was a tighter governor's race in virginia where democrat terry mcauliffe beat condition ken cuccinelli by less than 3%. terry is former head of the dnc. the big apple will have its first democratic mayor in two decades. bill de blasio romped over republican joe lhota in yesterday's election. de blasio will replace republican-turned-independent michael bloomberg stepping down after three four-year terms. the new jersey mall where a gunman fired multiple shots then killed himself reopened today with extra police officers on hand. 20-year-old richard shoop opened fire at the garden state plaza in paramus on monday night. investigators say shoop left a note with his family suggesting he would harm himself. no other injuries are reported. the mall is now playing for

so lucky. >> a lot of them being euthanized which is very sad. >> reporter: marilyn krieger owns several hybrids and is an expert on cat behavior. she says these cats can be trained, that they are smart, lively and loyal. but they need lots of mental stimulation and attention. >> a lot of people, unfortunately, get them for the wrong reasons and they are beautiful cats but they are soing anive. >> reporter: if you are not home, she recommends an outdoor enclosure or one of her tamer exotic hybrids. she won't sell her early generation cats to just anyone. >> if somebody wants them wild and they want that binge cat or that exotic cat, go for it. but if you have little children, do not attempt it. >> reporter: and don't attempt to keep them cooped up in a tiny apartment. these cats need room to roam. >> a cat specialist told us that choosing a breeder is just as important as choosing the cat. you want a facility that certainlyizes the animals --

socializes the animals early on. >> or you could just get a dog. >> some people like the cats. >> they're beautiful. might eat all the rest of the pets. >> or your child! [ laughter ] we have change coming our way. we have a lot of sunshine out there now and a few high clouds passing on overhead. otherwise, it looks like a great day outside. probably the warmest day of the week. you can see some of those high clouds drifting right over the bay bridge right now. the temperatures just heating up. 69 degrees in livermore. 68 in san jose. and 64 degrees in san francisco. i think as we head throughout the afternoon we'll see plenty of sunshine and a mix of sun and clouds. and tonight partly cloudy, mild, big changes coming our way. this will be the last day of the big strong ridge and once it begins to weaken, we'll see changes, maybe we start to talk about some rain in the next week. right now you can see a couple of these systems encroaching on the ridge of high pressure so couple of clouds over the ridge. we'll see clouds, some mild temperatures, and then after today, it looks like the

numbers are going to start to cool down. i want to show you this storm. this is some kind of storm! a super typhoon that's formed and headed directly toward the philippines. check out these winds, sustained, get this, this doesn't happen very often, sustained at 175 miles per hour and gusting to 205, moving out of the west to 21 miles per hour. the current track is going to take it right on shop in the central philippines. expecting it to move onshore tomorrow on the island. we are' talking about a major hurricane. this is a monster storm with a surge of up to 20 feet. potentially dangerous deadly storm system there. around the state today, 75 degrees in fresno, 74 sacramento, 70 monterey bay. temperatures around our bay generally in the 60s and also the 70s. so a very nice afternoon outside. as we look toward the next couple of days, we'll watch those temperatures cooling off a few degrees. and then it looks like as we head in toward monday and

closely here. google is now confirming reports you have seen right here on kpix 5 its floating barge will be used to showcase google's latest products. the barge under construction at treasure island has been the subject of much speculation. it also drew scrutiny from the coast guard and other bay area officials due to concerns over proper permits.
